Terms of Service for Nulu IA

Thank you for choosing Nulu AI! These Terms of Use come into effect when you access or use the services offered by Nulu AI or our affiliates. These include our application programming interface (API), software, tools, developer services, data, documentation, and websites, collectively referred to as "Services." The Terms encompass our Terms of Service, Sharing and Posting Policy, Usage Policies, and any additional documentation, guidelines, or policies that we provide.
By using our Services, you consent to these Terms. Our Privacy Policy outlines the procedures regarding the collection and usage of personal information. The Terms of Service guide the usage of our Services. Any terms that are not defined here would carry the meanings ascribed to them in the Terms of Use, Business Agreement, or any other agreement you have with us that governs your usage of the Services ("Agreement"). In the event of a conflict between the Terms of Service and your Agreement, the Terms of Service will take precedence.
For the purposes of these Terms, "Content" includes "Customer Content."
Beta Services
This section regulates your usage of services or features provided by Nulu AI in alpha, preview, early access, or beta versions ("Beta Services"). Beta Services are offered "as is" for testing and evaluation. Nulu AI does not guarantee any uninterrupted, error-free service or the security of the Content during the usage of the Beta Services. Unless prohibited by law, Nulu AI disclaims all warranties for the Beta Services, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, or peaceful enjoyment, and warranties arising out of any dealing or usage.
Terms
1. Registration and Access
To use the Services, you must be at least 13 years of age. If you are under 18, you need to obtain permission from a parent or legal guardian to use the Services. If you represent an individual or entity, you should have the authority to accept the Terms on their behalf. Registration for an account requires accurate and complete information. Your account credentials should not be shared outside your organization. You are responsible for all activities occurring under your account.
2. Use Requirements
2.1 Use of the Services. You are granted a non-exclusive right to use the Services according to these Terms. You should adhere to these Terms and all applicable laws while using the Services. Nulu AI and its affiliates own all rights, titles, and interests in the Services.
2.2 Feedback. We appreciate comments, suggestions, and proposals for improvements. If provided, we may use them without any obligation for compensation.
2.3 Restrictions. The Services should not be used in a way that infringes, misappropriates, or violates the rights of any person. You are not allowed to decompile, disassemble, translate, or try to discover the source code or underlying components of the Services' models, algorithms, and systems. You cannot use the output from the Services to develop competing models with Nulu AI or use any automated method to extract data or results from the Services. You must not misrepresent the output from the Services as human-generated or violate our Usage Policies. Transferring API keys without our prior consent is not allowed. If the API is being used for a children-directed website or application, do not submit personal information of children under the age of 13 or the applicable age of digital consent.
2.4 Third-Party Services. Any third-party software, services, or products used in connection with the Services are subject to their own terms, and we are not responsible for such third-party products.
3. Content
3.1 Its Content. The Services allow you to provide information ("Input") and receive information generated by the Services based on the Input ("Output"). Together, the Input and Output are referred to as "Content". Subject to your compliance with these Terms, Nulu AI assigns all rights, titles, and interests in and to the Output to you. This means you can use the Content for any purpose, including commercial purposes, if you comply with these Terms.
3.2 Similarity of Content. Due to the nature of machine learning, the Output may not be unique among users, and the Services may generate the same or similar output for different users. For example, if you ask, "What color is the sky?" the model may respond, "The sky is blue." Other users might ask similar questions and receive the same response. Responses generated for other users are not considered your Content.
3.3 Use of the Content to Improve the Services. We do not use the Content you provide or receive from our API ("API Content") to develop or improve our Services.
3.4 Accuracy. Artificial intelligence and machine learning are rapidly evolving fields. Due to the probabilistic nature of machine learning, the use of our Services may sometimes result in incorrect Output. It is your responsibility to evaluate the accuracy of any Output as per your requirements.
4. Suspension and Termination
4.1 Suspension. We may suspend or terminate your access to the Services if we reasonably believe that you have violated the Terms or pose a risk of harm to Nulu AI or others. We will endeavor to notify you in advance but reserve the right to act immediately to protect our interests or to comply with a law or regulation.
4.2 Termination. You may terminate your account at any time. We reserve the right to terminate your account and access to the Services if you fail to comply with these Terms.
5. Limitation of Liability
5.1 Exclusions. Nulu AI and its affiliates, suppliers, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, goodwill, or other intangible losses arising from your access to or use of, or inability to access or use, the Services, or any content obtained from the Services.
5.2 Limits. Nulu AI's and its affiliates', suppliers', and partners' total liability for any claims relating to the Services or these Terms, regardless of the cause of action, will not exceed the amount paid by you to us for the Services over the twelve (12) months preceding the date the claim arose.
6. Miscellaneous
6.1 Changes to the Terms. We may modify these Terms from time to time. We will notify you of any significant changes and, where required, seek your consent. By continuing to use the Services after the changes become effective, you agree to the modified Terms.
6.2 Governing Law. These Terms and any related action will be governed by the laws of the jurisdiction in which Nulu AI is based, without regard to or application of its conflict of law provisions.
6.3 Entire Agreement. These Terms constitute the entire agreement between you and Nulu AI regarding the Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter.
